Notarization is not the same as having a document certified by a Commissioner of Oaths. While every admitted attorney is automatically a Commissioner of Oaths, not every attorney is a Notary Public.

What is a Notary Public?

A Notary Public is an attorney with a further specialisation which legally empowers him/her to perform a wide range of administrative functions for local and international purposes including witnessing signatures, administering oaths, certifying the validity of documents, as well as the drafting and/or legalisation of certain documents. One such document which must be drafted and executed by a Notary Public is an ante-nuptial contract (“ANC”).

When is Notarization necessary/ required?

Notarization is commonly required when an original document is signed, or a copy of an original document is made, in one country but is intended to be used in another, however, certain local institutions also require documents to be notarized, i.e. the Health Professions Council of South Africa (HSPCA).
